These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FogSaaS, operating as Subfoxy ("Company," "we," "us," or "our"), governing your access to and use of the Subfoxy platform available at www.subfoxy.com (the "Service").
By creating an account or using the Service, you confirm that you are at least 18 years of age and agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Service Description
Subfoxy is a subscription tracking dashboard that helps individuals and businesses manage, monitor, and analyze their recurring subscriptions in one centralized interface. The Service enables you to:
Add, edit, and categorize your subscriptions
Track spending patterns and upcoming renewal dates
Import bank statement data via CSV for automatic subscription detection
Receive renewal reminders and spending insights
Export your subscription data
Bank CSV files uploaded for subscription detection are processed entirely within your browser and are never transmitted to or stored on our servers.
3. Account Registration
To access the Service, you must create an account by providing accurate and complete information, including your name and email address. You are responsible for:
Maintaining the confidentiality of your login credentials
All activities that occur under your account
Promptly notifying us of any unauthorized use at info@subfoxy.com
Ensuring your account information remains accurate and up-to-date
We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4.1 Free Trial
New users are eligible for a 14-day free trial of the Pro plan. During the trial period, you will have access to all Pro features at no charge. At the end of the trial, you will be automatically downgraded to the Free plan unless you subscribe to Pro. No payment information is required to start a free trial.
5. Payment and Billing
All payments for the Pro plan are processed securely through Lemon Squeezy, our third-party payment processor. By subscribing to the Pro plan, you agree to the following:
Recurring billing: Pro subscriptions are billed monthly at $4.99/month. Your payment method will be charged automatically at the beginning of each billing cycle.
Payment methods: We accept major credit cards, debit cards, and other payment methods supported by Lemon Squeezy.
Taxes: Prices are exclusive of applicable taxes. Any VAT, sales tax, or other charges required by your jurisdiction will be added at checkout.
Failed payments: If a payment fails, we will attempt to charge your payment method again. If payment cannot be collected after reasonable attempts, your account may be downgraded to the Free plan.
Payment security: Lemon Squeezy is PCI-DSS Level 1 certified. We never store your full card details — only the last 4 digits for reference purposes.
6. Cancellation and Refunds
6.1 Cancellation
You may cancel your Pro subscription at any time through your account settings or by contacting us at info@subfoxy.com. Upon cancellation:
You will retain access to Pro features until the end of your current billing period
Your account will be automatically downgraded to the Free plan at the end of the period
Your subscription data will be preserved, but features beyond Free plan limits will become inaccessible
6.2 Money-Back Guarantee
💰 30-Day Money-Back Guarantee: If you are not satisfied with the Pro plan, you may request a full refund within 30 days of your initial subscription payment. To request a refund, contact us at info@subfoxy.com with your account email and reason for the refund. Refunds are processed within 5–10 business days.
After the 30-day period, refunds are issued at our sole discretion and only in exceptional circumstances. Partial-month refunds are not provided for mid-cycle cancellations.
7. User Data Ownership
You retain full ownership of all data you enter into the Service, including subscription entries, notes, categories, and any other user-generated content ("User Data"). By using the Service, you grant us a limited, non-exclusive license to process your User Data solely for the purpose of providing and improving the Service.
You may export your User Data at any time (available on the Pro plan)
Upon account deletion, we will remove your User Data within 30 days, subject to legal retention requirements
We will never sell, license, or commercially exploit your User Data
8. Intellectual Property
All intellectual property rights in the Service — including but not limited to the software, design, logos, trademarks, text, graphics, and user interface — are owned by FogSaaS or its licensors and are protected by Turkish and international intellectual property laws.
You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service
The Subfoxy name, logo, and all related marks are trademarks of FogSaaS
You may not use our trademarks without prior written permission
9. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
Use the Service for any illegal, fraudulent, or unauthorized purpose
Attempt to gain unauthorized access to the Service, other accounts, or our systems
Interfere with or disrupt the integrity or performance of the Service
Upload or transmit viruses, malware, or other harmful code
Use automated means (bots, scrapers, crawlers) to access the Service without permission
Attempt to reverse engineer, decompile, or disassemble any part of the Service
Resell, sublicense, or provide third-party access to the Service
Violate any applicable law, regulation, or third-party rights
Violation of these terms may result in immediate account suspension or termination without prior notice.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Subfoxy is a subscription tracking tool and does not provide financial, tax, or legal advice. You are solely responsible for your financial decisions.
In no event shall FogSaaS, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to Subfoxy in the twelve (12) months preceding the claim.
11. Service Availability
We strive to maintain high availability of the Service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:
Scheduled maintenance (we will provide advance notice when possible)
Unscheduled maintenance to address critical issues or security vulnerabilities
Force majeure events beyond our reasonable control
Issues with third-party infrastructure providers (Firebase, Vercel)
We shall not be liable for any loss or damage resulting from Service unavailability.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes:
We will update the "Last updated" date at the top of this page
We will notify registered users via email at least 15 days before the changes take effect
Continued use of the Service after the effective date constitutes acceptance of the revised Terms
If you disagree with the updated Terms, you may cancel your account before the changes take effect.
13. Account Termination
We may suspend or terminate your access to the Service, with or without notice, if:
You violate any provision of these Terms
Your use of the Service poses a security risk or may cause harm to other users
We are required to do so by law or legal process
Your account has been inactive for more than 24 consecutive months
You may delete your account at any time through your account settings. Upon termination or deletion, your right to access the Service ceases immediately. We will retain data only as required by law or as described in our Privacy Policy.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. The Turkish Consumer Protection Law No. 6502 and related regulations shall apply to consumer disputes where applicable.
15. Dispute Resolution
In the event of a dispute arising from or relating to these Terms or the Service:
Informal Resolution: You agree to first attempt to resolve the dispute informally by contacting us at info@subfoxy.com. We will make good-faith efforts to resolve the matter within 30 days.
Consumer Arbitration Board: If the dispute cannot be resolved informally and falls below the statutory threshold, you may apply to the relevant Consumer Arbitration Board (Tüketici Hakem Heyeti) in Turkey.
Courts: For disputes exceeding the arbitration threshold or not resolved through the above means, the courts of the Republic of Turkey shall have exclusive jurisdiction. The specific court of competent jurisdiction shall be determined in accordance with Turkish procedural law.
For users in the EU, nothing in this section limits your right to bring proceedings in the courts of your country of residence as provided by applicable consumer protection law.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and FogSaaS regarding the use of the Service and supersede all prior agreements, understandings, and representations.
